Cybix Terms of Service

Welcome to Cybix, a software-as-a-service (SaaS) product provided by CyberGlobalNet LLC (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Cybix platform, including our website, web application, and mobile applications, and all associated services (collectively, the “Services”). By accessing or using Cybix, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
1. Overview
Cybix is a business software platform that allows customers to manage operations through various capabilities (e.g., billing, communication, telephony, messaging, chat, scheduling, fleet management, hiring, productivity, and AI assistance). Cybix is a brand of CyberGlobalNet LLC, a Maryland, USA-based company.
2. Eligibility
To use the Services, you must be at least 18 years old or the age of majority in your jurisdiction. By using Cybix, you represent and warrant that you meet this requirement.
3. Account Registration
Accurate and complete information must be provided during account creation. Account details must be kept up to date at all times. The confidentiality of account credentials must be maintained by the account holder. Workspaces are owned by an account owner, who may invite administrators and team members; the owner is responsible for managing access to the workspace.
4. Mobile Applications and App Stores
The Cybix mobile applications are distributed through third-party app stores, including the Google Play Store and the Apple App Store. Your download and use of the apps are also subject to the applicable app store’s terms. We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the apps on devices you own or control, solely to access the Services.
5. License and Restrictions
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Services. You agree not to:
- Reverse engineer, decompile, or disassemble the software;
- Sell, sublicense, or resell the Services without written permission;
- Use the Services for any illegal or unauthorized purpose.
6. Payment and Billing
We use third-party payment processors (e.g., Stripe and PayPal) to process payments. Subscription fees are based on your selected plan and may vary based on storage or usage. Payment is required at signup. We do not store full credit card details. If your account is canceled, your SaaS project will be deleted, but metadata (e.g., name, company info, billing records) may be retained for business and legal purposes.
7. Bits (Digital Usage Credits)
Certain usage-based features—such as telephony, messaging, and AI features—are powered by “Bits,” prepaid digital credits associated with your workspace. Only account owners and authorized administrators can purchase Bits. Bits are purchased through our third-party payment processor (Stripe) and are not sold through in-app purchase or app store billing, because they are consumable credits for a cloud business service used across the web and mobile apps. Bits are consumed as you use the related Services, are denominated for service usage only, have no cash value, and are non-refundable except where required by law. Pricing and consumption rates may change; we will reflect current rates in the platform.
8. Data Storage and Processing
Your SaaS project is hosted on servers leased from a third-party provider (e.g., Liquid Web). While CyberGlobalNet LLC manages the hosting environment, we do not own the physical infrastructure. We target 99.9% uptime. You may store sensitive or regulated data, but you are solely responsible for compliance with applicable laws, and for obtaining any required consents from individuals whose data you process through the Services (including your customers, employees, and contacts).
9. Third-Party Services and Integrations
We integrate with third parties (e.g., Twilio, Stripe, Stripe Identity, PayPal, Square, Clover, Intuit QuickBooks, Google, OpenAI, Anthropic, and others). We are not responsible for third-party services or their terms and privacy practices. Your use of an integration may be subject to that provider’s terms.
10. Domain Registration
If you choose to register a domain, your personal information will be shared with the registrar to complete the purchase. Domain registration is optional and governed by the registrar’s terms in addition to our Privacy Policy.
11. Modifications to Services
We may modify, suspend, or discontinue the Services (or any part of them) at any time, with or without notice. We are not liable to you or any third party for any modifications.
12. Termination and Account Deletion
Account owners may cancel their subscription and request deletion of their workspace and its data at any time from the Cybix portal at portal.cybix.us. Workspace data is owned by the organization and its account owner; administrators and team members should direct account or data deletion requests to their workspace owner, who can request deletion on the organization’s behalf, as described in our Privacy Policy and at https://cybix.us/delete-account. We reserve the right to suspend or terminate your access if you breach these Terms or engage in abusive or harmful behavior.
13. Indemnification
You agree to defend, indemnify, and hold harmless CyberGlobalNet LLC, its affiliates, officers, and employees from any claims, liabilities, damages, and expenses arising from your use of the Services or your violation of these Terms.
14. Warranties, Disclaimer, and Limitation of Liability
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
CYBERGLOBALNET LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
WE DO OUR BEST TO MAINTAIN SECURITY, BUT NO SYSTEM IS 100% SECURE. USE THE SERVICES AT YOUR OWN RISK.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Maryland, USA. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved exclusively in the courts located in Maryland. By using the Services, you waive the right to participate in a class action to the extent permitted by law.
16. Acceptable Use Policy
You agree not to use the Services to:
- Violate any applicable law or regulation, or infringe the rights of others;
- Send unlawful, unsolicited, or bulk communications (spam), or messages that violate telecommunications or anti-spam regulations;
- Transmit malware, or attempt to gain unauthorized access to the Services, other accounts, or our systems;
- Harass, abuse, threaten, defraud, or harm others, or impersonate any person or entity;
- Upload or distribute content that is illegal, infringing, or that you do not have the right to share;
- Interfere with or disrupt the integrity or performance of the Services.
17. Beta Features
From time to time, we may offer beta features for evaluation purposes. Such features may be modified or discontinued at any time and are provided “as is” without warranties of any kind.
18. Feedback
If you provide feedback or suggestions regarding the Services, we may use such feedback for any purpose without obligation or compensation to you.
19. Force Majeure
We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, government actions, or internet outages.
20. Changes to Terms
We may update these Terms at any time. We will notify you of changes via email or the platform. Continued use of the Services constitutes acceptance of the updated Terms.
